Terms and Conditions

These Terms and Conditions govern the supply of goods sold by The Handmade Album Company ("we" and "us") to the customer named on the order form provided on the Thehandmadealbumcompany.com website ("you"). Together with the completed order form, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.

Wrongly priced items

We continually update our website, however, if there is an error in the pricing we reserve the right to cancel your order and refund any monies paid in full. Notice will be given to you by email or by telephone.

Payment

The price payable for the goods you order is as set out on our website at the time you place your order.

We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage, before your order can be accepted unless we have agreed otherwise in advance in writing. We accept payment via PayPal and cheque / Postal Order. Please make cheque’s and postal orders payable to ‘Michelle Monaghan’. Please post cheques / Postal Orders to: Michelle Monaghan T/A The Handmade Album Co, 144 Bridgeness Road, Bo’ness, West Lothian, EH51 9LH.

Availability

While we endeavour to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, refund you the price paid for such goods as soon as possible and in any case within 30 days. Any orders placed for out of stock items will be accepted as advance orders. For items required for a specific date you may contact us to check on current workload and dispatch date. Whilst in transit by Royal Mail / Courier Company, The Handmade Album Company can accept no responsibility for delays on behalf of these third parties. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

Delivery & Title

All photo albums, guest books and keepsake boxes are custom made to order and as such require a 4-6 week production time depending on order level. By placing your order, you are accepting these terms. For personalised gifts, please allow 3-5 days for dispatch of your goods as each is individually personalised to order.  All items are sent Recorded Delivery / Courier as standard and a signature will be required upon delivery of your order. Next day delivery option means that an item is sent not using the previous, standard delivery, but using a service which guarantees a next day delivery, it does not however mean that your item will be dispatched immediately after placing an order as production time still applies - it is simply a faster postal method following dispatch of your goods. We will notify you when your item has been dispatched, please ensure someone is available to receive goods. If delivery is attempted but is not successful, and the order is returned to us, we reserve the right to charge for subsequent delivery attempts. If further charges arise we shall not be liable for payment of these charges.

Damaged Items

All damages must be reported to us no later than 24 hours after delivery. If you are unsure about the condition of your delivery (i.e. It appears to be damaged on arrival, or has evidence of ‘tampering’ please sign for the goods "unchecked". This allows us then to make a valid claim on your behalf with the delivery company. Failure to comply with this may mean that it may not be possible to replace/refund your goods. If we do agree to replace your item and require the original item back, we will only send out the replacement once the original is returned in full and checked by our staff.

Cancellation, Returns and Refunds

Personalised or custom made to order items are non-returnable / non-exchangeable. These orders must be cancelled within 24hours of their placement, as we manufacture as soon as possible after we receive your order. Please keep the original packaging. We reserve the right to refuse items returned without the original packaging. For regular, unpersonalised items cancellation is possible until 7 days after you have received your order. Such notice may be given by mailing or emailing The Handmade Album Company If cancellation occurs as a result of a problem / fault with the goods, please notify us of the problem at the time of cancellation. On cancellation, you must return the goods to us at your cost unless the goods are being returned because they are faulty or incorrect, in which case we will meet the cost of return based on our original dispatch cost. Refunds will be made within 30 days of the date the returned goods are received.

Please send any acceptable returns to: The Handmade Album Company, 144 Bridgeness Road, Bo’ness, West Lothian, EH51 9LH. We must be notified by email and you must await a reply before any item is returned. Your original order reference should always be included in the return packaging.

Safe return of the goods is the responsibility of the customer. We strongly advise that you return items using a First Class Signed for service or suitable alternative that shows goods signed upon receipt and also insures against any loss / damage should it occur during transit. Personalised items may not be returned unless there is an error in the personalisation made by The Handmade Album Company. Please check your order carefully before submitting as we will not accept financial liability for your error.

Should your items arrive damaged please retain all original packaging as Royal Mail will not consider a claim for damaged items without it. Contact us as soon as possible.

Distance Selling Regulations 2000

The Handmade Album Company adheres to the Distance Selling Regulations 2000, which state that from the time the order is placed up until seven working days from the "day after" the day the goods are received, the consumer has the right to cancel the order. Please note however that in the case of personalised items this condition is unreasonable and you are referred to the ‘Cancellations, Refunds and Returns’ section. For all other items, a refund of all monies including postage and packaging will be made by us within 30 days of cancellation. We will request that the goods (in their original condition) are returned at the consumers cost, and if they are not returned we will collect them and deduct the direct cost from the refund. This does not affect your statutory rights as a consumer.

Liability

If you have notified us of a problem with the goods, we will (at your option) either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

Termination

We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.

Complaints

Our policy is to respond to all complaints within 48 hours at the latest, although we aim to respond immediately. Please ensure you supply us with full contact details if communicating by email.

Privacy Policy

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will never pass your details on to any other company.

The type of information we will collect about you includes: your name address phone number email address. We will never collect sensitive information about you without your explicit consent. The information we hold will be as supplied by you. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

Handmade, Natural Paper

Please take note that our work will be produced to the best possible standard allowing for the difficulty of undertaking these processes on natural papers with the variations in thickness and texture inherent in these materials. Natural, handmade papers are thicker, more fibrous and often have a bumpy, rough texture.  In placing your order you accept this to be the case.
